Arbitration, as an alternative to the judicial proceedings, is a method of settling private law disputes by an independent and impartial arbitrator/arbitral tribunal, either voluntarily in line with the will of the parties or as an obligation arising from special regulations. The award is rendered by an authorized arbitral tribunal as a result of an arbitration agreement between the parties. However, foreign arbitral awards rendered outside Turkey can only be enforced in Turkey upon enforcement. Foreign arbitral awards can only be enforced in Turkey upon acceptance of an enforcement action. This article explains the enforcement of foreign arbitral awards process and its legal grounds.
